Terms and Conditions Cosy Carpets Website Terms and Conditions – September 2025

What these terms cover. These terms and conditions set out the basis upon which we supply our products and services to you.

Why you should read them. Please read these terms carefully before placing an order. They explain who we are, how we provide products, your rights and responsibilities, how the contract can be changed or terminated, what to do if there is an issue, and other important information.

Information about us and how to contact us

Who we are. We are Cosy Carpets & Flooring Limited (“we”, “us”, “our”), a company registered in England and Wales under company number 16182595, with our registered office at Midland Road, North Walsham, Norfolk, NR28 9JR.

How we contact you. We will communicate with you via telephone, email, or by writing to the postal address you provide in your order.

“Writing” includes email. Any reference to “writing” or “written” in these terms includes communication by email.

Our contract with you

How you place an Order. Confirmation of our quotation by you constitutes an offer to purchase products in accordance with these terms (your “Order”).

How we accept your Order. Our acceptance will occur on the earlier of:

  • when we confirm acceptance in writing, or
  • when we commence fulfilment of your Order,
    at which point a binding contract is formed.

If we cannot accept your Order. We will notify you if we are unable to accept your order and you will not be charged. Reasons may include stock unavailability, unforeseen capacity constraints, errors in pricing or description, or inability to meet a delivery date you have requested.

Geographical scope. We supply products only within the UK. Orders from outside the UK cannot be accepted.

Quotation validity. Quotations are not offers and remain valid for 14 days from issue unless otherwise agreed in writing.

Our products

Product variations. Images on our website and marketing materials are for illustrative purposes. We strive for accuracy but cannot guarantee exact colour or finish due to display and printing limitations.

Accuracy of measurements. If products are manufactured to your specifications, you are responsible for ensuring the accuracy of those measurements.

Your rights to request changes

If you wish to amend your order, please contact us. We will confirm whether the change is possible and advise of any price, delivery, or timing adjustments. You will then confirm if you wish to proceed.

Our rights to make changes

We may amend products:

  • to comply with law or regulatory requirements, or
  • to make minor technical improvements,
    which will not materially affect your use of the products.

Providing the products

Delivery and installation costs. These are set out in our quotation.

Delivery arrangements. Once your Order is confirmed, we will agree a delivery and/or installation date with you.

Delays outside our control. If delivery is delayed due to circumstances beyond our control, we will notify you. We will not be liable for such delays provided we act reasonably, but you may cancel the contract if the delay is substantial and receive a refund for undelivered products.

Collection. If you choose collection, this can be arranged during our published business hours (available at www.cosycarpets.co.uk).

Failed delivery. If no one is available, we will leave a note with instructions for re-arrangement. Additional storage or delivery charges may apply if you fail to collect or accept delivery.

Access for installation. You must ensure our installers have safe and reasonable access. If this is not provided, we may charge for additional costs or terminate the contract.

Late delivery rights. If products are not delivered on time, you may treat the contract as ended immediately if:

  • we refuse to deliver,
  • delivery by the agreed date was essential and notified to us, or
  • you informed us in advance that timely delivery was critical.

Risk and ownership. Products become your responsibility upon delivery or collection. Ownership passes once full payment is received.

Information required. We may need certain details (e.g., room measurements). Failure to provide these may result in delays, extra charges, or termination.

Suspension. We may suspend supply to resolve technical issues or if payment is overdue. If suspension exceeds 30 days, you may cancel and receive a refund.

Ending the contract – your rights

Your right to cancel before delivery. You may end the contract before delivery and installation. Depending on the circumstances, charges may apply.

Good reason to cancel. Full refund (plus potential compensation) applies if:

  • we notified you of an error in price/description and you do not wish to proceed,
  • supply is significantly delayed due to events beyond our control,
  • products are suspended for more than 30 days, or
  • you have another legal right due to our breach.

No good reason. You may still cancel but we may deduct reasonable costs.

Returning products. If cancelled after delivery, products must be returned at your cost unless cancellation is due to our error, in which case we will cover return costs.

Ending the contract – our rights

We may end the contract if:

  • you fail to pay after reminders,
  • you do not provide necessary information, or
  • you fail to accept delivery or allow installation.

We will refund sums paid for undelivered products but may deduct costs incurred due to your breach.

Problems with products

How to report issues. Contact us using the details in clause 2.

Your legal rights. These remain unaffected.

Returns. Products rejected under your legal rights must be returned in-store or collected by us.

Guarantee. In addition to statutory rights, we guarantee for 12 months from installation that products will:

  • conform to description/specification,
  • be free from material defects,
  • be of satisfactory quality, and
  • be fit for intended purpose.

If notified of defects, we may repair, replace, or refund at our discretion.

Exclusions. Guarantee does not apply if defects arise from:

  • failure to follow instructions,
  • reliance on your measurements,
  • unauthorised alterations, or
  • normal wear and tear, misuse, or negligence.

Price and payment

Price. The price (including VAT) will be as set out in our quotation.

Installation costs. As specified in your quotation.

Errors. If an error in pricing is discovered, we will confirm the correct price and seek your instructions before acceptance.

Payment terms.

  • For products manufactured to your measurements: payment in full before delivery.
  • For products measured by us: 50% deposit before manufacture, balance within 7 days of installation.
  • Installation charges: payable directly to the installer upon completion.

Late payment. Interest is chargeable at 4% above Barclays Bank plc base rate on overdue amounts.

Liability

Foreseeable loss. We are liable for foreseeable loss caused by our breach or negligence but not for losses unforeseeable at the time of contract.

No limitation for unlawful exclusions. Our liability is not excluded for death, injury, fraud, or statutory rights.

Property damage. We will repair damage caused by our services except for pre-existing defects.

Business use. Products supplied are for domestic use only. We accept no liability for commercial or resale use.

Personal information

Your data will be used in accordance with our Privacy Policy: www.cosycarpets.co.uk.

Other important terms

  • Transfer. We may transfer this contract; you may only do so with our consent.
  • Third-party rights. Only you (and transferees of our guarantee) have enforceable rights.
  • Severability. If a clause is found unlawful, the remainder remains effective.
  • Delay in enforcement. Failure to enforce rights immediately does not prevent later enforcement.
  • Governing law. These terms are governed by English law. Legal proceedings may be brought in English courts, or if you live in Scotland or Northern Ireland, in your local courts.
